1. Services Provided
BlueMark Pools provides residential and commercial pool cleaning, maintenance, and related services. Certain services, including equipment repairs, renovations, or construction, may be performed by licensed third-party contractors when required by law.
BlueMark Pools coordinates and manages service delivery but does not perform work requiring a contractor’s license unless properly licensed at the time services are rendered.
2. Service Scheduling & Access
Clients agree to:
– Provide safe and unobstructed access to the pool and equipment
– Ensure pets are secured during service windows
– Maintain appropriate water levels and operational equipment unless otherwise agreed
Missed services due to lack of access, unsafe conditions, or weather-related limitations may still be billable at BlueMark’s discretion.
3. Service Limitations
BlueMark Pools is not responsible for:
– Pre-existing damage to pool surfaces, tile, plaster, decking, or equipment
– Structural issues, leaks, or underground plumbing failures unless explicitly contracted
– Damage caused by faulty or aging equipment
We do not guarantee cosmetic results beyond standard industry practices.
4. Chemicals & Water Quality
Pool chemistry is influenced by factors beyond our control, including:
– Weather conditions
– Bather load
– Water source quality
– Equipment performance
BlueMark Pools strives to maintain balanced water chemistry but does not guarantee specific chemical readings at all times.
5. Repairs & Third-Party Contractors
When applicable, BlueMark Pools may recommend or coordinate repairs through licensed contractors. Any construction, remodeling, or repair services requiring licensure are performed by third-party professionals operating under their own licenses, insurance, and contractual obligations.
BlueMark Pools is not responsible for the workmanship, timelines, or warranties of third-party contractors unless otherwise stated in writing.
6. Billing & Payment
– Payment terms are agreed upon at service initiation
– Late payments may result in service suspension
– Returned payments may incur additional fees
– Pricing is subject to adjustment with prior notice
Monthly service fees are billed regardless of the number of service days in a month
7. Cancellations & Termination
Clients may cancel service with written notice in accordance with their service agreement. BlueMark Pools reserves the right to terminate service for:
– Non-payment
– Unsafe working conditions
– Repeated access issues
– Misrepresentation of pool condition
8. Liability Limitation
To the fullest extent permitted by law, BlueMark Pools shall not be liable for:
– Indirect, incidental, or consequential damages
– Loss of water, chemicals, or utilities
– Equipment failure beyond routine inspection
Our total liability shall not exceed the amount paid for services rendered during the previous billing cycle.
9. Indemnification
Clients agree to indemnify and hold harmless BlueMark Pools from claims arising from:
– Unsafe property conditions
– Undisclosed equipment issues
– Client modifications made between service visits
10. Website Use
All content on this website is owned by BlueMark Pools and may not be copied, reproduced, or distributed without written consent.
Use of our website does not create a service agreement.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
12. Changes to Terms
BlueMark Pools reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
